Bankruptcy Trustee Asks Politicians To Return Durham's Contributions

WRTV's Rafael Sanchez reports that the bankruptcy trustee for Fair Finance Company has sent letters to several prominent Indiana politicians asking them to return to the bankruptcy estate for the benefit of creditors nearly $1 million in campaign contributions Tim Durham made to their campaigns. Marion Co. Prosecutor Carl Brizzi was the largest recipient of Durham's generosity, collecting $225,000 in total campaign contributions. Gov. Mitch Daniels campaign committee received $195,000 from Durham, while the Indiana Republican Party received $185,000 from Durham. Former Marion Co. GOP sheriff candidate Tim Motsinger earlier returned $200,000 Durham had loaned to him before dropping out of the sheriff's race.  Daniels had earlier told reporters he would not return any money because it had already been spent on his 2008 re-election campaign. A spokesman for Daniels, however, told Sanchez he may reconsider that earlier decision. A spokesman for the state party says it's too soon to say whether any money will be returned.

Of course, the GOP, Daniels, and Brizzi should return Durham's contributions. It is scandalous that the bankruptcy trustee would have to take it on himself, to ask politicians to do this.

Many people wonder what they can expect in bankruptcy court. The first thing that occurs is the meeting with a bankruptcy trustee. The meeting could take place in the trustee's office or a room in the courthouse. After this first meeting, you will receive a notice about the first meeting with the creditors. This part requires that you answer questions under oath. Creditors will ask you any questions that they need answered truthfully. The meeting does not take very long. Sometime it is less than twenty minutes.

When you arrive at bankruptcy court, you need to have the proper documents along. You will need your social security number and a state issued photo identification card. You will need the deed to your home if you own a home as well as any papers showing the total due on car loans. If you file chapter 13, you need current tax returns and paycheck stubs to prove your income.
