Ward succeeded, coming so close to Stewart&#39;s car as to place him in peril of being contacted by Stewart&#39;s car.<br /><br />Ward, being a driver, saw that condition of the track was yellow, not red, so he knew cars were circulating. Cars circulating under yellow can cause significant harm to a person on the track.<br /><br />This will be a very difficult prosecution. A DA is used to DUIs and drug cases and has little ability to prosecute cases that have a level of scienter above strict liability.<br /><br />It will be very difficult for the prosecution to carry it burden of proof that Stewart formed some manner of mens rea in the second, or so, he saw Ward standing in the corner under yellow.<br /><br />Further, bringing such a prosecution may jeopardize the Watkins Glen race and the proposed Hoboken Formula 1 race.
