I have evaluated the video, the anger issues of Tony Stewart, and circumstance. I drew my own conclusion.

Anon 5:12 is correct that Stewart may get by a jury that must prove a crime beyond "reasonable doubt." He may even fool a jury that liability and intent were not proven beyond a "preponderance" of evidence.

Judgment day....we'll see.

By the way, I am saying these things by looking at the video. It might not have been Kinney driving the car that was in front of the the blue #45, it is just that after that car passed, Ward took some quick steps farther down the track.

The problem is that the video does not show a car that looks like it could have been Kinney's (mostly orange with white trim) before Ward took a couple of quick steps down the track where the blue #45 swerves to avoid him, Stewart was a second behind him.

It does not matter what Kinney says about seeing Ward clearly, as Ward was taking quick steps down the track.

Even if you had Stewart miked and he was screaming "I'm gonna kill this kid," it's going to be near impossible to get a conviction when the darned kid is walking around the race track when it's full of moving cars. Since there doesn't appear to be anything close to that, it's simple media feeding time - terribly sad, but still media feeding time
