You make excellent points, IndyRob. The New York Times had a story over a year ago about how the vast majority of terrorist prosecution cases brought by the federal government since 9/11 involved undercover FBI agents plotting with unsuspecting targets to carry out terrorist attacks. I'm certain this younger brother lacked the training to build such sophisticated explosive devices (he flunked out of his college chemistry class), and I will need to be convinced the older brother, a college dropout, possessed such knowledge and training. The money issue really bothers me. How were these two brothers able to afford expensive cars to drive, including Range Rovers, BMWs and Mercedes, at least according to the guy who serviced their cars, and buy expensive clothing, when neither was gainfully employed?

I think that the whole thing is a result of a failed FBI entrapment operation. My thinking is that the brothers (or maybe just the older one) was recruited by an FBI informant as part of the US war on terror. The brothers were encouraged to think about bombing the marathon and somehow or other slipped out of the FBI's watch. The FBI has an history of targeting disgruntled Muslims in these bomb plots and then arresting them as they attempt to set off a fake bomb.
The FBI made two mistakes, they lost track of the brothers and accidentally recruited someone how knew how to make a bomb.
The FBI was not sure how badly they messed up so they issued a bomb-watch-terrorist alert to the security group at the marathon, this explains the "drill" at the start of the marathon. When the marathon security forces did not find anything, they decided that the brothers were not actually going to do anything. The FBI was then caught by surprise after the bombs went off but they already had very good pictures of the brothers. They then went through all of the photos (hundreds of thousands spectators photographed how many times) looking specifically for photos of those two and when they found them, they announced loudly "these are the guys" so they could release photos to the boston PD.
When that MIT patrolman say the brothers (using better photos than were actually eventually released), he decided to try to arrest them by himself, the brothers killed him, starting the entire martial-law manhunt procedures.

I think the surviving bother will die in custody without ever making any statement, that somehow the actual photos provided to the police will be leaked, that no one will actually question how the investigators identified 2 men out of millions of photos, and that the quality of the released photos was so awful.

I guess since we don't have a Constitution any...

I guess since we don't have a Constitution any longer, we no longer have a government, but only thugs and thieves running things. I imagine that some people in government are writing an 'after action' report focusing on the behavior of the citizens of Boston and how readily they complied with the authorities. Let's see, two of the requisites:

1. Terrorist/criminal "on the run" possibly wearing a suicide vest.

2. Unarmed citizenry.
